Terms of Service

These Terms of Service ("Terms") govern access to and use of the EasyEval website, applications, and services (the "Service"). If you are using the Service on behalf of a school or district, you represent that you have the authority to bind that organization to these Terms.

1. Scope and eligibility

The Service is intended for K-12 administrators, school leaders, and authorized staff. The Service is not intended for student use.

2. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us promptly of any unauthorized access.

3. Acceptable use

• Do not use the Service for unlawful, harmful, or discriminatory purposes.
• Do not attempt to probe, scan, or test the vulnerability of any system.
• Do not upload content that infringes on third-party rights.

4. Customer data and privacy

You retain ownership of your data. We process data only to provide the Service. Our Privacy Policy describes how data is handled, including AI processing and retention.

5. AI features

EasyEval may use AI to help summarize notes, map evidence, and draft feedback. You remain responsible for reviewing and approving outputs before use in evaluations.

6. Subscriptions, billing, and trials

Subscriptions renew automatically unless canceled. Fees are non-refundable except as required by law or explicitly stated in a signed agreement. Trials may be provided at our discretion.

7. Third-party services

The Service may rely on third-party providers (for example, cloud hosting, payments, and email). Your use of the Service is subject to those providers' terms where applicable.

8. Intellectual property

We retain all rights to the Service, including software, designs, and branding. You may not copy, modify, or reverse engineer the Service except as permitted by law.

9. Confidentiality

Each party will protect the other's confidential information using reasonable care and will use it only to fulfill obligations under these Terms.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied.

11. Limitation of liability

To the maximum extent permitted by law, EasyEval will not be liable for indirect, incidental, or consequential damages, or for loss of data, profits, or goodwill.

12. Termination

We may suspend or terminate access if these Terms are violated. You may cancel at any time through your account or by contacting support.

13. Governing law

These Terms are governed by the laws of the state where EasyEval is headquartered, without regard to conflict-of-law principles. Venue will be in the courts located in that state.

14. Changes to these Terms

We may update these Terms from time to time. If changes are material, we will provide notice by posting an update on this page or via the Service.
